NIL Club LLC ("Company," "NIL Clubs," "we," "us," or "our") respects your privacy and is committed to protecting it through our compliance with this privacy policy (the "Policy").


This Policy describes the personal information we may collect from you or that you may provide when you visit nilclub.com or any of our NIL Club websites, including the NIL Club applications, or otherwise contact or interact with us offline (collectively, the "Services"), and our practices for collecting, using, maintaining, protecting, and disclosing that information. In this Policy, "you" refers to any individual about whom we collect personal information.


As used in this Policy, "personal information" refers to information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, to you, and includes "personal data" or similar terms used in applicable law.


If you do not agree with our policies and practices, including as set out in this Policy, your sole choice is not to use the Services. We reserve the right, in our sole discretion, to change, modify, add, remove, or otherwise revise portions of this Policy at any time. When we do, we will post the change(s) to our Services. Your continued use of our Services following the posting of changes to these terms means you accept these changes. If we change the Policy in a material way, we will provide appropriate notice to you. Such notice may be provided via a temporary banner on our website, an email sent to users for whom we have an email address, or by temporarily noting "UPDATED" next to the Policy link on the footer of our website.

We collect the categories of personal information identified below. We disclose these categories to service providers for business purposes, such as processing donations, maintaining user accounts, and otherwise facilitating our Services. We do not "sell" or "share" personal information, or engage in "targeted advertising" as such terms are defined by applicable privacy laws.

  • To send you technical notices, updates, security alerts and support and administrative messages.

  • To improve and optimize our Services (for example, by generating analytics about how our customers browse and interact with our Services).

a. Information You Provide to Us

The personal information you provide to us directly on or through our Services may include:


  • Information that you provide by filling in forms on our website or through the use of our Services. This includes information provided at the time of registering to use our Services, subscribing to any of our Services, posting material, or requesting further services. We may also ask you for information when you report a problem with our Services.


  • Information accessed from or added to your address book ("Contacts") to facilitate communication and connections within NIL Clubs (described in further detail below).


  • Records and copies of your correspondence (including email addresses), if you contact us.


  • Content you submit through the Services, including, but not limited to, your posts and comments including saved drafts, your messages with other users (e.g. private messages, chats and comment) and other communications.


  • Your responses to surveys that we might ask you to complete for research purposes.


  • Details of interactions you carry out through our Services.

User contributions: You also may provide information to be published or displayed (hereinafter, "posted") on public areas of the Services, or transmitted to other users of the Services or third parties (collectively, "User Contributions"). Your User Contributions are posted on and transmitted to others at your own risk. Although we limit access to certain pages, please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of other users of the Services with whom you may choose to share your User Contributions. Contacts Data

When signing up for an account on NIL Clubs, you have the option to give NIL Clubs access to your address book to find friends ("Contacts") on NIL Clubs. We may also add information to your address book to facilitate communication and connections.

We use your Contacts to identify other users that you may know or that your Contacts may know. We use this information to provide you and other users with suggestions on whom to invite. We may also present your Contacts as options for various interactions if you do not have a significant number of invitations on the app. We may add contact details (such as phone numbers) from the app.


You can invite Contacts to join NIL Clubs by sending them a text message with a link to install the app. The invitation may include your name and the names of your teammates on NIL Clubs. In order to help increase the benefits of your NIL Clubs account, we may assist you by sending messages to your friends on your behalf. You also have the opportunity to send the message yourself.


When another user uploads their contact list, we may combine information about you from that user's contact list with other information we have collected about you.


We will request your consent to access or add to your Contacts data if required by applicable law. You may withdraw your consent at any time by contacting info@nilclub.com, but such withdrawal will not affect the lawfulness of the processing prior to the withdrawal.


If you wish to delete your contacts data that you previously allowed us to access or add, please contact us at info@nilclub.com. Please note that deletion requests are subject to certain exceptions and limitations.


No mobile data from dedicated short code opt-ins will be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt in data and consent; this information will not be shared with any third parties.


We implement reasonable and appropriate security measures to help protect the safety of your Contacts data.


b. Information We Collect Through Automatic Data Collection Technologies

As you navigate through and interact with our Website and use our Services, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including:


  • Details of your visits to our Website or the use of our Services, including traffic data, location data, log and usage data, and other communication data and the resources that you access and use on the Website.
